PURCHASE WAIVER
ASSUMPTION OF RISK
RELEASE OF LIABILITY AGREEMENT
RETURN POLICY
WARNING
Airsoft guns and accessories are not ‘toys’ intended for children. Airsoft is
mentally and physically intense sport. The risk of
physical injury from the activity and products involved in Airsoft is
significant, including the potential for permanent disability and
death. While protective equipment and personal discipline will minimize this
risk, potential for serious injury does exist. I hereby
acknowledge that I understand and recognize the risks, dangers and perils
connected with all Airsoft activities, but nonetheless find
them wholly satisfactory and acceptable to me and/or any children I am
responsible for.
ACKNOWLEDGEMENT OF TERMS
As the purchaser of one or more products from The Kapowwe Company, I hereby
state and represent that I have read, understand,
acknowledge and agree to the terms and conditions listed herein.
NOTE - If you are under 18 and have your parents' or guardian’s permission, they
must to fill out this waiver, sign it and agree to the
terms listed below. This means by signing this waiver, they accept full
responsibility for the Airsoft gun and accessories purchased
from The Kapowwe Company. Parents or guardians, legal or otherwise, of any child
falsifying his/her age are solely responsible for any
action taken upon that child.
− I, being 18 years of age or older, I agree that
The Kapowwe Company is not responsible or liable for my actions, or the actions
of any child I am responsible for (legally or
otherwise), with any product purchased from The Kapowwe Company
− I am aware of any local/state/federal laws governing the use and ownership of
Airsoft products and that there are no laws
that prevent me from owning/purchasing these products from The Kapowwe Company
− I understand that by federal, state, and/or other laws removal of warning
stickers, paint, or markings on any The Kapowwe Company
products is strictly prohibited, and will also void all warranties.
− I agree that I will use this product in a lawful manner, and not in connection
with any criminal offense or crime. I further
understand that applicable federal, state, and/or other laws provide that the
use of an Airsoft gun in any crime may carry the
same ramifications of a crime committed with a real firearm, or weapon.
− I agree to indemnify and hold harmless The Kapowwe Company, its officers,
owners and employees, from and against all
liabilities, damages, penalties, claims or other obligations arising out of my
use and/or ownership of any products sold by
The Kapowwe Company.
AGREEMENT
I KNOWINGLY AND FREELY agree accept full and sole responsibility for my
purchase, including all risks (both known and
unknown), even if they arise from the negligence of those persons released from
liability below. I, for myself and on behalf of my
heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE AND
HOLD HARMLESS, The Kapowwe Company, its
officers, officials, agents, and/or employees, hereinafter referred to as ‘Releasees’,
WITH RESPECT TO ANY AND ALL LIABILITY
FOR NEGLIGENT OR CRIMINAL ACTS, INJURY, DISABILITY, DEATH, INCLUDING LOSS OR
DAMAGE TO PERSON OR
PROPERTY.
I understand and agree that this ‘Purchase Waiver – Assumption of Risk - Release
of Liability Agreement’ shall remain in force and
effect from this day forward covering each and every subsequent purchase from
The Kapowwe Company. Waiver, Assumption of Risk
and Release of Liability Agreement as applies may not be revoked, altered,
amended, rescinded or voided without the express prior
written consent all parties.
I hereby state that I have answered all of the above truthfully and I hold The
Kapowwe Company and all of its agents harmless of any
and all legal action arising from my purchase from the aforementioned company. I
HAVE READ THIS PURCHASE WAIVER –
ASSUMPTION OF RISK - RELEASE OF LIABILITY AGREEMENT COMPLETELY, FULLY UNDERSTAND
ITS TERMS, AND
WILLINGLY GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT FREELY AND WITHOUT ANY
INDUCEMENT.
RETURN POLICY
Overview:
We want to insure customers receive working merchandise so we offer a 14 day
warranty against factory defects. If you receive an item, take it out of the
box, and it does not work, we address that by fixing/replacing the item. When an
item has been modified, taken apart, dropped...etc we do not offer a warranty
against that type of damage. Shipping expenses are incurred by the customer. The
purchase of an RMA is required for any returned item (see below). This is a
general overview, read below for full details.
Damaged in transit
We must be notified within 3 business days of the delivery. We will arrange for
UPS to inspect and pickup the package from the customer.
Canceled orders
There is a 4% credit card processing fee, that is only if the order can be
stopped in time. You must physically speak with someone or get a response via
email to confirm a canceled order. Sending an email or v-mail is not adequate to
expect a canceled order. We ship so quickly, that it is difficult for us to stop
an order once it has been placed. Please do not purchase from us unless you are
sure of the purchase.
Free items
We offer no refunds or exchanges for free items. These are overstocked or
discontinued items and we prefer to give them away.
If you forgot to include the free item(s) in your order, please make a separate
purchase of any amount (.25 cents) is fine and note in the "special
instructions" during Checkout that you forgot the free item and for us to
include it with this follow-up order. Do not call or email and request us to
include it in your order. If the free item is "missing" from your package, it
will not be shipped separately.
Blow out/$.99/Special Sale items
Any items marked blow out or that are found in the free/ almost free category have no warranty impressed or implied. These items are being liquidated at below cost, and are not covered by any warranty. If you receive a $.99 item that does not work or is damaged, you may however note that in your special order instructions on your next order and we would be happy to send you an additional one free of charge providing that the item is still in stock.
Unwanted items
Refunds on unopened merchandise within the first 7 days of delivery will consist
of the cost of the item ONLY less a 20% restocking fee & shipping charges (NOTE:
Even if shipping was free at purchase). We will not refund the cost of shipping.
New, unopened items can be exchanged. If the item was used at anytime, we cannot
refund the purchase. Item(s) must be returned in our possession within 30 days,
no exceptions.
Non-Refundable/Exchangeable items
Non-refundable or Exchangeable items include any paint products, special order
items, used items (i.e. items sold as used), and batteries. Batteries can be
misused without our detection; therefore, all sales are final. Special order
items are noted on the website as having a "2-3 week delivery time".
International Orders
We do not ship outside the USA. If you purchase from us, and your billing
address is outside the USA, your order will be refunded minus 10%.
Halloween Seasonal Orders
No warranty or refunds will be issued for orders placed from Oct 1 - Nov 1
regardless of reason given. Again, regardless of reason absolutely no monetary
refunds for any order placed in the month of October.
Removal Of Orange Tip
If we receive a return with the orange tip removed or modified, that item will
be disposed of at the customer's expense. The warranty is void, and we will not
offer any refund. Do not send us an airsoft or toy gun missing the orange tip
for whatever reason.
All Other Items
There is a 14 day repair/replacement warranty against manufacturers defects
only. The warranty period begins the day the product arrives in the mail or is
purchased in the store. This warranty ONLY covers manufacturer's defects, not
wear and tear, neglect, dropping, and/or misuse. An externally broken part is
not a manufacturer's defect. The warranty is automatically void if the product
is altered, modified, disassembled in any way. The item must be mailed back at
the customer's expense for inspection. There is NO warranty expressed or implied
after the 14 day period. Item(s) must be returned to us within the 30 days of
purchase, no exceptions.
We do not accept "trade-ins" on used merchandise. For example a low-end electric
rifle is purchased, used a few days, now would like to send it back for a more
expensive model.
The return policy covers repairs/replacement of the same product. We do not
offer a monetary refund once the item has been used.
We repair/replace items that have manufactures defect only. If the item is found
to be broken or worn in some other manner, the customer is required to pay for
the return shipping costs.
Determination of a manufactures' defect is established by our technical staff.
